The American company Car-Freshner Corporation, known for producing automotive fragrances Little Trees, filed a lawsuit against the brand of designer clothing and accessories Balenciaga, reports TMZ . According to the company, Balenciaga sells key chains for keys that looks identical with the popular Christmas tree flavors.
Keychains can be found on the Balenciaga website, they are sold in four colors. “Yolochka” is made of calfskin, on it – the brand logo, brass ring on top. One such keychain costs $ 275, and the description on the site indicates that their design is “inspired by automotive flavors.”
Car-Freshner Corporation said they have a brand name for Christmas tree flavoring since 1952, and their design is so popular that it was licensed by large corporations, including Kia Motors and Buffalo Wild Wings. However, in Balenciaga, permission to use the design was not asked, although key chains have been selling for a month in a boutique in New York.
Balenciaga should transfer to Car-Freshner Corporation a share of the sales, the plaintiff demanded. Representatives of the designer brand did not comment on the situation.
In Russia, Little Trees flavors are sold at 199 rubles per pack of three. Balenciaga copied even the colors of popular flavors: for example, black matches the smell of “black ice” or “anti-tobacco”, pink – “morning freshness”, green – “green apple”, blue – “smell of a new car”.
